It is an offence for anyone to illegally deposit litter in a public place or on private land. Penalties that may be applied under the Litter Act 1979:

Deposit of litter in public place or on private land

(1) Every person that commits an offence and is liable, in the case of an individual, to a fine not exceeding $5,000 or, in the case of a body corporate, to a fine not exceeding $20,000, who deposits any litter or, having deposited any litter, leaves it:

(a) in or on a public place; or
(b) in or on private land without the consent of its occupier.

(1A) Subsection (1) is subject to subsection (2).

The illegal dumping of rubbish or littering of any kind in public places, on roadside and parks and reserves is an offence under the Litter Act 1979.

Any person or individual committing such offence is liable to an instant fine of $400, or on prosecution a fine not exceeding $5,000.

Council asks that you report incidents of this nature so that follow up action may be taken. If you have witnessed illegal dumping of rubbish, please contact Council.

A Customer Service Representative will ask for details including the type of material dumped, location, the car registration and description of the offender. This information is treated as confidential.
