Boundary Fences Adjoining Council Land
Are you wanting to build or repair a fence between your property and one of Council's parks or reserves? The good news is, if you meet certain requirements, we may pay up to half the cost.
Checking your Certificate of Title
For us to consider your application we'll need to check your Certificate of Title. If it contains a Fencing Agreement in Deed or Fencing Covenant this means we're not responsible for the cost of erecting, maintaining, or repairing a fence.
If your certificate doesn't contain this covenant and you'd like to request that we share the cost of a fence, please complete the Shared Council Land Boundary Fence Application Form.
Our requirements
To ensure new fences are well built, reasonably priced, and can be easily maintained, we'll generally support your proposal if it meets the requirements set out below.
Paling fence
- Council's standard fence is 1.8m high, posts 100mm x 75mm and placed no more than 2.75 metres apart.
- Upright timber palings well nailed to 2-3 rails with a gap of no more than 40mm between palings.
- All rails and palings should be tanalised and ground posts treated.
- Concrete mowing strip of at least 125mm parallel to the central line of the fence. This strip should be at least 150mm wide from the point directly beneath the outermost face of the fence on the side towards the Council land.
- If Council agrees to a height above our standard, we'll only contribute financially to a 50% contribution of our ‘standard fence’ height - this means we don't financially contribute to the ‘nice to have’s’.
Painted fence
Council doesn't paint our boundary fences and we don't contribute to the cost of paint for fences.
Alternate types of fences
We may agree to your proposal for another type of fence if it fits in with the type of park you live by. We won't agree to hedges or any form of living fences due to ongoing costs to ratepayers associated with the maintenance and upkeep of Council's side. Councils' contribution will only be half the cost of our standard paling fence type.

Processing of your application
If we oppose any part of your proposal, we'll reply within 21 working days of getting your notice. If you don't receive a reply within this time, you have the right to go ahead with the work and we'll honour our half share of the cost if it's in alignment with our fencing requirements.
Work needs to be completed within 90 days of the date given in your notice for starting work. After this period all arrangements would be null and void. Any fence erected between private and Council land needs to be maintained in good condition.
Occupier caused damage
If boundary fence damage has been caused by either the occupier, visitor or owner of the adjoining boundary property to Council Land. The full cost of the replacement will be their responsibility as per the Fencing Act 1978 - Section 17.
