Dangerous and Insanitary Buildings Policy 2023

The Dangerous and Insanitary Buildings Policy was reviewed and adopted by Council in November 2023.

Purpose of the policy

This policy is focused on ensuring people can live and work in buildings without compromising their health or safety, and sets out the approach Council will take to identify and deal with dangerous and insanitary buildings.

Council is responsible for managing the policy through the Building Act 2004 and will apply it to any building where the current conditions mean the building could be dangerous, affected or insanitary. Buildings must meet the definitions outlined in the Building Act to be considered dangerous, affected or insanitary and Council will work with building owners on any reasonably practicable options available to them.

Heritage buildings are covered by the policy and will be assessed in the same way as other dangerous, affected and insanitary buildings. And, where heritage buildings are identified as dangerous, affected or insanitary discussions will be held with owners of the building, Heritage New Zealand Pouhere Taonga and other stakeholders to identify a mutually acceptable way forward. Special efforts will be made to meet heritage objectives specified in the Operative District Plan.

Policy review

This policy will be reviewed on a 5 yearly basis from the date of adoption as required by section 132(4) of the Building Act 2004.
